You may not copy, reproduce, distribute, or create derivative works without prior written permission from EcoPal.

The Site and App may contain links to third-party websites or services. EcoPal does not endorse and is not responsible for the content, privacy policies, or practices of third parties. Your interactions with third parties are solely between you and the third party.

9. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, ECOPAL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ECOPAL DOES NOT WARRANT THAT THE SITE OR APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

IN NO EVENT SHALL ECOPAL, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR APP, EVEN IF ECOPAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ECOPAL'S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID, IF ANY, TO ECOPAL FOR ACCESS TO THE SITE OR APP IN THE 12 MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless EcoPal, its officers, directors, employees, agents, and partners from any claim, demand, loss, liability, or expense (including legal fees) arising out of your breach of these Terms or your violation of any law or rights of a third party.

12. Termination

EcoPal may suspend or terminate your access to the Site or App at any time for any reason, including if you breach these Terms. Sections concerning Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law shall survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state or federal courts located in Cincinnati, Ohio.

14. Changes to These Terms

EcoPal may revise these Terms at any time. When changes are made, EcoPal will update the "Last updated" date. Your continued use of the Site or App after the effective date of any revised Terms constitutes acceptance of those changes.
